Osibanjo Oluwaseun, a driver for the Lagos State Bus Rapid Transit (BRT) was brought before an Ikeja High Court on Tuesday after allegedly killing six persons when his vehicle collided with a train at Ikeja.

The state government has filed 16 counts against the defendant, who was arraigned before Justice Oyindamola Ogala. The charges relate to past damage and involuntary manslaughter.

Babajide Martins, the director of public prosecutions, testified in court that the BRT driver murdered the victims carelessly when he disregarded warning signals and struck an approaching train.

He said the defendant also negligently inflicted grievous harm on 10 other passengers on the bus.

Some survivors said the 44-year-old driver, Oluwaseun Osinbajo, had his earpiece on while driving and ignored the directive of the Flag Officers at the rail line.

The driver, however, blamed the incident on a mechanical fault in the bus.

The driver, who works with the Lagos State Ministry of Transport, was also said to have been transferred to the State Criminal Intelligence and Investigations Department.

The government had said that the driver would be charged on six charges of manslaughter and ten counts of grievous bodily harm. It noted that both offences were against Sections 224 and 245 of the Lagos State Criminal Code from 2015.

The Director of Public Prosecution (DPP), Dr. Jide Martins, reviewed the case file and established a prima facie case of manslaughter and grievous bodily harm against the driver of the staff bus, according to a statement released by the office of the Director of Public Affairs in the state’s Ministry of Justice.
